Robert Kelly (Kelly) was convicted of kidnaping, attempted sexual battery and lewd and lascivious assault on a person under the age of sixteen. Subsequent to his convictions for these offenses, the trial court granted the States motion to declare Kelly to be a sexual predator pursuant to the Florida Sexual Predators Act (the Act), section 775.21, Florida Statutes (2000). Kelly appeals his convictions and the trial courts declaration finding him to be a sexual predator. We affirm his convictions and the sexual predator designation.
