The first charged defendant under § 40A-16-3, N.M.S.A. 1953, with unauthorized entry of a building with intent to commit theft. The second count charged larceny of personal property having a value in excess of $100.00 under § 40A-16-1, N.M.S.A. 1953. Defendant entered a plea of guilty to the first count, the second count was dismissed.
